Chapter 78

א אסורין בחותם אחד חילתית מורייס פת גבינה מותרין בחותם אחד
1 but hiltit, murias, bread and cheese are permitted with one seal.
ב פת למאי ניחוש לה אי משום איחלופי קרירא בחמימא מידע ידיע דחיטי בדשערי נמי מידע ידיע אי כי הדדי כיון דאיכא חותם אחד לא טרח ומזייף
2 Why should we be concerned about bread? Were he to change a fresh loaf for a stale one, the receiver would know. Or a loaf of wheat for one of barley, he would know! If they are the same, since there is one seal attached he would not take the trouble to commit a fraud.
ג ורב מ"ש גבינה דלא טרח ומזייף חלב נמי לא טרח ומזייף אמר רב כהנא אפיק חלב ועייל חתיכת דג שאין בה סימן
3 And to Rav why is cheese different, in that [the non-Jew] would not take the trouble to commit a fraud [and allows one seal]; likewise with milk he would not take the trouble to commit a fraud [and yet Rav demands two seals]? R. Kahana said: Strike out the word “milk” and insert “a piece of fish” which has no distinguishing mark.
ד היינו בשר תרי גווני בשר
4 But that is the same as meat. There are two kinds of meat.
ה ושמואל אומר בי"ת אסור בחותם אחד מח"ג מותר בחותם אחד בשר יין תכלת אסורין בחותם אחד מורייס חילתית גבינה מותרין בחותם אחד לשמואל חתיכת דג שאין בה סימן היינו בשר תרי גווני בשר לא אמרינן
5 Shmuel said: Meat, wine and blue wool are prohibited with one seal; but murias, hiltit and cheese are permitted with one seal. According to Shmuel, a slice of fish which has no distinguishing mark is regarded as the same as meat, and we do not say that there are two kinds of meat.
ו ת"ר אין לוקחין ימ"ח מח"ג בסוריא לא יין ולא מורייס ולא חלב ולא מלח סלקונדרית ולא חילתית ולא גבינה אלא מן המומחה וכולן אם נתארח אצל בעל הבית מותר
6 Our Rabbis taught: We do not buy in Syria wine, murias, milk, salkondorit salt, hiltit or cheese, unless it be from a reliable dealer; but if [an Israelite] is the guest of a host there, they are all permitted.
ז מסייע ליה לרבי יהושע בן לוי דא"ר יהושע בן לוי שגר לו בעל הבית לביתו מותר מ"ט בעל הבית לא שביק היתירא ואכל איסורא וכי משגר ליה ממאי דאכיל משדר ליה:
7 This supports the statement of R. Joshua b. Levi who said: If [a Syrian] householder sends him [as a gift any of these foods] he may eat them. What is the reason? A householder would not leave what is allowed and eat what is forbidden, and if he sends anything to him [it may be assumed that] he sends him from what he himself eats.
ח ומלח סלקונדרית: מאי מלח סלקונדרית אמר רב יהודה אמר שמואל מלח שכל סלקונדרי רומי אוכלין אותה תנו רבנן מלח סלקונדרית שחורה אסורה לבנה מותרת דברי רבי מאיר רבי יהודה אומר לבנה אסורה שחורה מותרת רבי יהודה בן גמליאל משום רבי חנינא בן גמליאל אומר זו וזו אסורה
8 And salkondorit salt. What is salkondorit salt? Rav Judah said in the name of Shmuel: Salt of which all Roman guests partake. Our rabbis have taught: Black salkondorit salt is prohibited and the white is permitted, the words of R. Meir. R. Judah says: The white is prohibited and the black permitted. R. Judah b. Gamaliel says in the name of R. Hanina b. Gamaliel: Both kinds are prohibited.
ט אמר רבה בר בר חנה אמר רבי יוחנן לדברי האומר לבנה אסורה קירבי דגים לבנים טמאים מעורבין בה לדברי האומר שחורה אסורה קירבי דגים שחורים טמאים מעורבין בה
9 Rabbah b. Bar Hanah said in the name of R. Yohanan: To the one who declared the white to be prohibited, the intestines of unclean white fish are mixed with it; to the one who declared the black to be prohibited, the intestines of unclean black fish are mixed with it;
י לדברי האומר זו וזו אסורה זה וזה מעורבין בה אמר רבי אבהו משום רבי חנינא בן גמליאל זקן אחד היה בשכונתנו שהיה מחליק פניה בשומן חזיר:
10 and to the one who declared both kinds to be prohibited, [the intestines of] both species of fish are mixed with them. R. Abbahu said in the name of R. Hanina b. Gamaliel: There was an old man in our neighborhood who used to polish this salt with pig fat.
יא הרי אלו אסורים: למעוטי מאי לחזקיה למעוטי בידוע לרבי יוחנן למעוטי מורייס וגבינת בית אונייקי וסתמא כר"מ:
11 Behold these are prohibited. What does this intend to exclude? According to Hezekiah it excludes [those preserved foods] in which it is known [that wine is included]. According to R. Yohanan it excludes murias and Bithynian cheese, and the anonymous statement [in the Mishnah] is that of R. Meir.
יב <big><strong>מתני׳</strong></big> ואלו מותרין באכילה חלב שחלבו עובד כוכבים וישראל רואהו והדבש והדבדבניות אע"פ שמנטפין אין בהן משום הכשר משקה וכבשין שאין דרכן לתת לתוכן יין וחומץ וטרית שאינה טרופה וציר שיש בה דגה ועלה של חילתית וזיתי גלוסקאות המגולגלין
12 The following are permitted to be eaten [by an israelite]: 1) milk which a non-Jew milked with a Jew watching him; 2) honey, 3) grape-clusters — even though these secrete moisture the law which renders food susceptible to defilement by a liquid does not apply to them — 4) preserves into which they are not accustomed to put wine or vinegar, 5) pickled herring which has not been minced, 6) brine containing fish, 7) a leaf of asafoetida, 8) and rolled olive-cakes.
יג ר' יוסי אומר השלחין אסורין החגבים הבאים מן הסלולה אסורין מן ההפתק מותרין וכן לתרומה:
13 Rabbi Yose says: those olives having pits ready to drop out are prohibited. 9) Locusts which come out of [a shopkeeper’s] basket are prohibited, but if from storage they are permitted. The same rule applies to terumah.
יד <big><strong>גמ׳</strong></big> תנינא להא דת"ר יושב ישראל בצד עדרו של עובד כוכבים ועובד כוכבים חולב לו ומביא לו ואינו חושש היכי דמי אי דליכא דבר טמא בעדרו פשיטא ואי דאיכא דבר טמא בעדרו אמאי
14 GEMARA. We have already taught this, as the rabbis have taught elsewhere: If an Israelite is sitting near a non-Jew's flock and the non-Jew milks and brings some to him, he need have no concern [and is allowed to drink it]. How is this to be understood? If there is no unclean animal in the flock, it is obvious; but if there is an unclean animal in the flock why [should he be permitted to drink the milk]!
טו לעולם דאיכא דבר טמא וכי קאי חזי ליה וכי יתיב לא חזי ליה מהו דתימא כיון דיתיב לא חזי ליה ניחוש דלמא מייתי ומערב ביה קמ"ל כיון דכי קאי חזי ליה אירתותי מירתת ולא מיערב ביה:
15 It does indeed deal with a case when there is an unclean animal, but [the Israelite is in such a position that] when he stands up he can see the non-Jew and when sitting he is unable to see him. What might you have thought? Since he cannot see him when sitting, he should be concerned that he might bring him [milk in which something forbidden] has been mixed; therefore it teaches us that since he is able to see him when standing, the non-Jew would be afraid to mix anything with the milk.
טז והדבש: דבש למאי ניחוש לה אי משום איערובי מיסרא סרי אי משום בישולי עובדי כוכבים נאכל כמו שהוא חי אי משום גיעולי עובדי כוכבים נותן טעם לפגם הוא ומותר:
16 Honey. Honey, what should he be concerned about? If because of the possibility that something [forbidden] may have been mixed with it, this would cause it to go rancid! If it is on account of [the prohibition against] all things cooked by a non-Jew, it is something which is eaten in its raw state! If on account of the rule that vessels used by non-Jews must be scoured [before they may be used] by a Jew, it is an instance where a worsening flavour is imparted and it is therefore permitted.
יז והדבדבניות אף על פי שמנטפות אין בהן משום הכשר משקה: ורמינהי הבוצר לגת שמאי אומר הוכשר הלל אומר לא הוכשר ואודי ליה הלל לשמאי
17 Grape-clusters — even though these secrete moisture the law which renders food susceptible to defilement by a liquid does not apply to them. This was contrasted with the following: If one gleans grapes for the wine-press, Shammai says that they are susceptible to impurity [by liquid] while Hillel says that they are not susceptible; And Hillel agreed with Shammai.
יח התם קא בעי ליה למשקה הכא לא קא בעי ליה למשקה:
18 There, he needs the grapes for their liquid, whereas here [in our mishnah] they are not required for a liquid.
יט וטרית שאינה טרופה: תנו רבנן איזו היא טרית שאינה טרופה כל שראש ושדרה ניכר ואיזו ציר שיש בה דגה כל שכילבית אחת או שתי כילביות
19 A tarit fish which is not minced: Our Rabbis have taught: How do we define “a tarit fish which has not been minced”? One whose head and backbone are recognizable. And how do we define “brine containing a fish”? One that has one or two kalbit-fish
